Urban Active Fitness Club Faces Class Action Lawsuit
According to Dispatch, Urban Active fitness-club is facing a class action lawsuit alleging it has violated Ohio consumer-protection laws. The lawsuit was filed in Franklin County Common Pleas Court and says that the fitness-club chain engages in a pattern of unfair and deceptive conduct in violation of Ohio consumer-protection laws. Amber Gascho of Powell filed the lawsuit alleging that she was told she could not cancel her personal training contract without a $10 fee, but when she ended the contract she was instead charged $250. Gascho claims the company failed to provide her with signed contracts at the time and that they failed to tell consumers of their rights to cancel the contract within three days. Additionally, the fitness club failed to provide consumers with notice of cancellation forms, misrepresented the terms of contract cancellation and did not honor consumers’ notices of cancellation. American Airlines Class Action Lawsuit Dropped
According to Legal News Line, the Illinois Supreme Court has ruled against a Northbrook woman who brought on a class action lawsuit against American Airlines over a $40 baggage fee. Andrea Barber claims she purchased a ticket through the airline company from Chicago to White Plains, New York in 2008. Prior to boarding, she checked two suitcases and was charged by the airline a $40 checked baggage fee. The airline canceled the flight, Barber received a refund for the initial ticket but not her baggage fee. Barber filed a class action lawsuit four days after her flight was canceled. She claimed a counter agent advised her it was not American Airlines’ policy to refund fees paid for transportation of luggage in conjunction with a passenger when that flight is cancelled by the airline and the passenger does not accept another flight.
