Class Action Lawsuit Filed Against Crayola

Crayola makes crayons whose vibrant hues are usually celebrated, but a new class action lawsuit against Crayola states that one of the company’s new products is too colorful. Three different plaintiffs from Texas, Oregon and New York want restitution for the damage caused by Crayola’s Washable Colored Bubbles, which left stains on one of the plaintiff’s patio furniture and wood deck. According to KCBY, fine print on the bubbles’ bottles warns that stains must be washed immediately, repeated laundering may be required and the product should be kept away from brick, vinyl, wood, wallpaper, painted walls, carpeting and draperies. In addition, Crayola’s website recommends specific cleaning products for each kind of stain removal. Members of the class action lawsuit want truthful advertising on the bottle’s label, in that the company removes the “washable” part of the title. Numerous Asbestos Violations Found at Tribal Schools

The Department of the Interior’s (DOI) Indian Affairs Office allegedly violated several waste, water, air, toxic and community right-to-know laws at tribal schools in Arizona and the New Mexico-Navajo territory, including asbestos exposure regulations. According to Las Vegas TSG Business News, the U.S. Environmental Protection Agency announced a settlement to protect students’ health and communities’ health in Indian Country by reducing these environmental hazards. Notably, the settlement included 14 asbestos violations, including failure to identify asbestos containing building material in school buildings, failure to maintain asbestos containing thermal systems and failure to ensure proper asbestos awareness training for custodial and maintenance staff. The settlement affects 60 tribes throughout the U.S. with DOI Indian Affairs Office schools, and it gives four years for the DOI to use $234,844 on asbestos compliance in the schools. Navy Veteran Wins $32 Million in Asbestos Case

Courts in New York recently awarded Ronald Dummitt, who served in the U.S. Navy for 28 years, with $32 million for past and future pain and suffering due to asbestos-related mesothelioma. According to WSAZ, the jury determined that Crane Company and Elliott Turbomachinery Company, both of which manufactured parts containing asbestos, failed to warn the veteran about the dangers of asbestos exposure. Dummitt worked with the parts these companies produced during his time aboard Navy ships, from 1960 to 1977, and he now suffers from pleural mesothelioma. Dummitt’s exposure occurred when he repaired valves manufactured by Crane, since this process involved removing and replacing lagging pads, gaskets and packing that contained asbestos. Dummitt’s second exposure to asbestos occurred when he removed and replaced lagging pads and manhole gaskets containing asbestos while working with deaerating feed tanks manufactured by Elliott Turbomachinery. Victims of Mesothelioma Not Counseled on Legal Rights

A study conducted by the U.S. Department of Veterans Affairs and Stanford University researchers found that only a small percentage of patients diagnosed with mesothelioma received counseling on the cause of the disease or the chance to take legal action, according to Surviving Mesothelioma. Occupational asbestos exposure causes almost all cases of mesothelioma, and a history of asbestos exposure is a key part of making an accurate diagnosis. In the study, researchers reviewed 16 patients’ charts, and 75% of the charts noted occupational exposure to asbestos. However, the charts indicated that only one patient received counseling about the cause of his mesothelioma and opportunities for compensation from those at fault for his exposure. Researchers concluded that physicians diagnosing mesothelioma are missing opportunities to help the patient, especially since many states have post-diagnosis time limits in which to file a mesothelioma lawsuit.
