Urban Active Fitness Club Faces Class Action Lawsuit
According to Dispatch, Urban Active fitness-club is facing a class action lawsuit alleging it has violated Ohio consumer-protection laws. The lawsuit was filed in Franklin County Common Pleas Court and says that the fitness-club chain engages in a pattern of unfair and deceptive conduct in violation of Ohio consumer-protection laws. Amber Gascho of Powell filed the lawsuit alleging that she was told she could not cancel her personal training contract without a $10 fee, but when she ended the contract she was instead charged $250. Gascho claims the company failed to provide her with signed contracts at the time and that they failed to tell consumers of their rights to cancel the contract within three days. Additionally, the fitness club failed to provide consumers with notice of cancellation forms, misrepresented the terms of contract cancellation and did not honor consumers’ notices of cancellation. Judge Rejects Medical Monitoring Class Action Against Philip Morris
According to Sun Herald, a federal judge rejected a request by a group of California plaintiffs seeking class action certification in a medical monitoring lawsuit. The judge said there was no reliable way to identify the class members. U.S. cigarette maker Philip Morris said the judge dismissed the medical monitoring claim after a New York judge dismissed a similar claim in January. The company said these decisions should have significant influence on two other cases in which plaintiffs are seeking medical monitoring. Speaking on behalf of Philip Morris, the company’s spokesperson said that the decision is consistent with existing law and the overwhelming majority of previous decisions denying class certifications. All previous cases, including this class action suit, were brought on by smokers. Website Faces Class Action Lawsuit Over Free Credit Report Advertising
According to Mint Life, individuals who may have fallen for a free credit report may be eligible to participate in a class action lawsuit. You may have seen commercials for websites offering free credit reports. According to the suit, one website is not so-well-known, but appears to be bringing people in for misleading credit checks. David Waring alleges that Consumerinfo.com, essentially Experian, deceived him because the credit score provided was not the actual score sold to lenders. In their advertising, the website alleged that the credit score is factual and used to assess credit worthiness. The score available on consumer info.com is a “Plus” score model not available to commercial lenders and cannot be used to determine an individual’s credit worth. Match.com Class Action Lawsuit Alleges Website Allows Sex Offenders to Join
According to Reuters, Match.com will start checking users against the national sex offender registry after a class action lawsuit was filed by a female user allegedly assaulted by a man she met on the popular dating site. A Hollywood executive, identified only as Jane Doe, claims she was sexually assaulted by another Match.com member, Alan Paul Wurtzel, who had been convicted six times of sexual battery, but still was allowed to join the website and seek female companions. The class action lawsuit was filed in Los Angeles County Superior Court. The plaintiff’s attorney said that the woman met Wurtzel on Match.com in 2010, and the two decided to meet in person. According to the lawsuit, Wurtzel raped the victim and related felony charges are pending.
